INSTRUCTIONS
AND PROCEDURES FOR VARIANCE REQUEST
FOR

STEP
1: OBTAIN ALL FORMS AND
INSTRUCTIONS
A.
The applicant obtains all forms from Board Secretary
B.
Forms
Required
1.
Standard
Application Form;
2.
Affidavit
of Service of Notice;
3.
Affidavit
of Publication of Notice;
4.
Affidavit
of County Planning Board (only required if located on County road, property
drains

County
road);
5.
Certification
of Tax Payment (obtain from City Tax Collector)
STEP
2: COMPLETE ALL FORMS
Applicant
completes application
A.
General
1.
Be as
precise as possible;
2.
Leave
nothing blank. If question is not applicable, stated “not applicable” or
“none”.
B.
Notarization
1.
The variance application for must be signed and
notarized by a N.J. Notary Public.
C.
Tax
Payment Certification musk accompany all applications. Certification is
available at the. City Tax Collector’s Office, City Hall, 140 North Broadway.
D.
Fees must be submitted with the application.
Variance Fees are as
follows:
Bulk
Variance (e.g. yard setback, lot coverage, height, etc.) $100 for each bulk
variance requested.
Use
Variance $500.
Fees
are to be paid by check or money order given to the Secretary of the Board of
Adjustment; payable to “City of
South Amboy
”.
STEP
3: PREPARATION OF PLANS
A
plan for variance application should be based upon a recent property survey or
sketch of a survey and provide the minimum details outlined in the variance
Application Completeness. Checklist
available from the Board Secretary or shown in the Zoning
Ordinance, Section.54, Form A.
STEP
4: SUBMIT APPLICATION
A.
Materials
required to be submitted:
1.
Variance
Application — 1 original plus 15 copies (Original must be notarized).
2.
Tax
Payment Certification — one (1) copy;
3.
Variance
Fee Payment;
4.
Variance Plan — Sixteen (16) copies;
B.
Location
and Deadline — Submit above materials to the Secretary of the Board of
Adjustment, at least 21 days prior to the public hearing at which you wish to
be heard. Materials not submitted by the deadline will not be placed on the
agenda for the meeting.
STEP
5: NOTIFICATION
A.
Prior
to serving notice and advertising, the applicant must:
1.
Receive
notification of Completeness letter from Board Planner;
2.
Contact Board Secretary to determine if there is an
opening
on the next agenda for your application.
B.
Notice
of the requested variance(s) must be given to the following:
1.
All
property owners within 200’ of the property boundary;
2.
A
list of property owners within 200’ must be obtained from the City Tax
Assessor for a fee and submitted to the Board Secretary.
3.
If
within 200’ of another municipality, the Clerk of the adjacent municipality
must be notified.
4.
If
adjacent to a County road or other County property or 200’ of another
municipality, the County Planning Board municipality must be notified.
5.
If
adjacent to a state highway, notice must be given to the State Commissioner of
Transportation.
C.
Legal
Notice must go
into newspaper (The Home News & Tribune, or The Citizen) at least 10
days prior to the hearing date. Applicant
should use the standard form of Legal Notice found in the application packet of
documents. The Affidavit of Publication must be requested from the
newspaper and submitted to the Board Secretary prior to or at the public hearing
fox the application.
D.
Notice
of Adjoining Property Owners
within 200’ of application site:
1.
Notice
Form — Applicant should use the standard notice to adjoining property
owners forms found in the applicant packet of
documents.
2.
Methods
of Service Notice
a.
By
sending certified mail and submitted to Board the postal certified mail slips
as proof of mailing,
b.
Hand
delivery of notice containing form to all property owners
3.
Deadline
for Notifications - individual service of notice to all adjoining property
owners must be completed at least 10 days prior to the hearing
date.
E.
Proof
of Notice
1.
Affidavits
of proof of service for notice are required for all variance applications.
2.
Affidavit
forms are available in the packet of application documents.
3.
Affidavit
forms must be notarized.
4.
Affidavits must be submitted prior to or at the
public hearing.
STEP
6: THE PUBLIC HEARING
A.
Dates,
Time, Location
Regular
meetings of the Board of Adjustment are held on the second Wednesday of each
month at 7:30PM at the
South
Amboy
City Hall
located at 140 North Broadway, South Amboy, NJ 08879.
